The Rising Tide of Wage-and-Hour Lawsuits
The DOL’s Wage and Hour Division (WHD) is now actively investigating not only outright wage-and-hour abuse, but also the sometimes-unintentional misclassification of employees as either exempt employees or as independent contractors when they are in fact hourly employees subject to overtime rules and pay. Another recently announced goal is to crack down on businesses using unpaid interns in place of regular employees. Compliance starts with the proper classification and payment of a company’s workforce.
