How to avoid FLSA Class Action Lawsuits

Does your organization know the difference between the employee classifications? Many companies don’t understand when to properly classify employees as exempt versus non-exempt, and consequently whether to pay overtime. Most think all you have to do to avoid paying overtime is make an agreement with the employee to pay them on a salary basis. While a salary basis test is part of the requirement to make an employee exempt from overtime, that is just a small part of the analysis. Startups are particularly susceptible to this, as staffing is constantly in flux, employees work long hours, and entrepreneurs are still learning the ropes as they go.

The Fair Labor Standards Act (FLSA) – Hotels and Motels

The primary function of a hotel or motel is to provide lodging facilities to the general public. In addition, most hotels or motels provide food to guests and many sell alcoholic beverages. These establishments may also earn revenue from other activities such as valet services offering cleaning and laundering of garments for guests, news stands, and renting out rooms for meetings, lectures, trade exhibits, and weddings.

Child Labor Violations Hits a Phoenix McDonalds Restaurant

The department reported that Bill Taylor, president of B&D Taylor Inc., which owns the McDonald’s on Sweet Air Road in Phoenix, has paid $20,502.05 in back wages to five workers, two of whom are still in his employ. The workers were not compensated for overtime hours, federal officials said. The company will also pay $9,990 in penalties for violating restrictions on the hours minors can work and tasks they can perform, officials said. Taylor could not be reached for comment Tuesday.

Keeping the Department of Labor Off Your Doorstep

The report surveyed more than 4,000 workers in three cities and concluded “employment and labor laws are regularly and systematically violated,” with 1.1 million workers having at least one pay-based violation per week. The study concluded that front-line workers lose more than $56.4 million per week in underpaid wages. Claiming violations in virtually every major urban industry, the report found.

Child-Labor Violations Filed Against Orem-based Western Wats plans to appeal the federal penalties of $552,750

Minors in the workplace will cause problems if not monitored. The department says the company violated child-labor provisions by employing 1,482 minors and not following the rules on wages and how many hours youthful employees are allowed to work. Three of the employees were 13; the rest were 14 and 15.

Restaurants cited for labor violations

Grocer in Kansas cited by Labor Department For Child Labor Violations

 How many laws in the FLSA pertain to child labor?  There are enough child labor laws to easily run up a tab of over $35K in fines when employers don’t pay attention to employees over-all work hours, evening work hours and  minor’s handling dangerous equipment.

It is the job as an employer to be aware of total hours worked, time of work and equipment handling when part of your work force is made up of minors.
