Does your awareness of the Fair Labor Standards Act keep you out of harms way? Federal investigators regularly look for violations of minimum wage, overtime pay, child labor and other provisions of the Fair Labor Standards Act. Employers not found to be in compliance must pay back wages and penalties. Recently, the Department of Labor launched a new smartphone “app” to help employees track the hours they work and determine the wages they are owed. These electronic time-sheets could result in more employers being hit with wage-and-hour-related violations. Here are 14 ways that your company or organization can get tripped up by these complex requirements. Every company should have systems and processes in place to address the FLSA regulations.

Today’s workforce is more mobile than ever. Employees’ lifestyles result in frequent changes in their employment and benefit status. Regulations are continually changing and expanding. All of these contribute to a more dynamic and complex work environment and tax even the largest HR staff’s time, resources and expertise.

What happens if the DOL asserts that an employer has violated the law? The DOL will require the employer to take action to correct the violations, which can include payments of back wages to employees. These payments may go back two or three years. The DOL has other tools at its disposal as well. It may seek an injunction to prevent the employer from committing future violations. This can be an especially dangerous tactic because, if the employer commits future violations, it could be found in contempt of the court’s order and be subjected to additional penalties and/or sanctions. The DOL can also impose fines of up to $1,000 per employee for willful violations. In rare cases, it can seek criminal prosecution. It may also refer any violation of immigration laws to the Department of Homeland Security.

Who’s handling you HR audits in 2010. An HR audit can be conducted by your HR staff, an outside consultant or an employment law attorney. This individual must have significant HR experience and should use a checklist or structured method to assess a company’s risks and needs. In addition to bringing key advice and knowledge of all pertinent laws to the table, an audit conducted by an outside consultant can add an extra layer of credibility to the findings of the audit. Records from a self-audit do not have the same credibility as audits done by independent sources; however it is better to do a self-audit than not audit at all.
