Breaks and Rest periods should be a concern in the workplace.  Employee breaks will be a problem for the workplace.  Under state law, employees working an eight-hour shift are guaranteed two fifteen-minute paid breaks and a thirty-minute unpaid lunch break. Since the employer’s payroll system would probably deduct thirty minutes for lunch, if a worker skips lunch and keeps working, an employee is working without pay during that time.

The new administration has an alert for employers.  President Obama just celebrated his first year in office and his Administration has been busy! Employers of all sizes are starting to see the effects of the Obama Administration’s workplace agenda; especially at the Department of Labor (DOL). The watchword for all employers in the wage/hour arena for 2010 is “compliance.” The DOL is slated to receive a substantial budget increase this year and it is going on a hiring spree to increase the number of investigators and enforcement personnel.

Discrimination and Retaliation Charges Are Near Record Levels Claims EEOC

What Employers Need to Know About Employee Retaliation

Employee retaliation is on the rise in the workplace.  In fiscal year 2009, there were 93,277 workplace discrimination charges filed nationwide.  While a single charge filing may have multiple types of discrimination charges, 36 percent of the filings alleged discrimination based on retaliation and 36 percent alleged discrimination based on race.

Important Answers to Your Questions of Employee Retaliation

Employers beware of employee retaliation.  If any adverse employment action is taken against you because you have complained or cooperated with another employee who has complained, or reported what you understand and believe to be illegal activity by your employer, your employer may be subject to liability for violating provisions of the California Fair Employment and Housing Act, the California Labor Code, or other state law and analogous federal law. Whether your complaints of discrimination or harassment are found to be valid is unimportant. Once you complain about what you believe to be discrimination or harassment and your employer takes adverse action against you, your employer is subject to liability regardless of whether discrimination and harassment in fact occurred.

A Shift In Enforcement By Immigration and Customs Enforcement (ICE)

The shift in immigration enforcement.  What new with Immigration Customer Enforcement?  But that was then, under a different presidential administration. Nowadays, ICE, which is part of the U.S. Department of Homeland Security, has shifted its focus away from undocumented workers and is targeting the employers who hire them. Rather than obtaining search warrants and kicking down doors, agents tend to call ahead before showing up to inspect paperwork. However, with this change in focus, owners, executives, and managers must take extra precautions to ensure that they do not end up paying hefty fines or even going to jail.
