What Employers Should Know and Expect From USCIS Fraud Unit

The USCIS Fraud unit has a lot employer should expect.  These site visits are expected to become more and more frequent.  For example, the USCIS Vermont Service Center has indicated it has transferred approximately 20,000 cases to the FDNS as part of the H-1B assessment program. It is assumed that the USCIS California Service Center has also forwarded a comparable number of cases for review. This is an addition to the cases that are referred to the FDNS based on a standard profile worksheet, which is completed by the USCIS adjudicators as part of the regular H-1B adjudication process. Therefore, it appears that FDNS officers will be appearing at the offices of numerous H-1B employers (and their clients if the beneficiary is assigned to one of the employer’s clients) within the next few months to gather information about their compliance with the H-1B program.

Are There Secrets On What Companies Are Getting Sued Over?

Employers have to be aware of Title VII and other employment violations.  Thanks to Jon Hyman over at the Ohio Employer’s Law Blog who wrote the other day on Do you know? Employment Litigation Expected to increase in 2010. It was an eye opener. I clicked through from his blog to the Fulbright & Jaworski Fifth Annual Litigation Trends Survey and Highlights and read through the employment law section. Easton, MA Business, Cited For Wage and Hour Violations

Attorney General Martha Coakley’s Fair Labor Division cited South Easton-based Proline Industries Inc. and its owner, David Cheffro, 46, of Brockton, for failure to submit certified payroll records to the awarding authority on a weekly basis and failure to pay employees in a timely manner.

Some Companies Are Worried About The New Administrations Policies

The Obama Administration has taken up where the previous administration left off.  The Bush administration tried to reduce that number by trying to stop the flow of illegal immigrants into the country. Earlier this year, the Department of Homeland Security announced a new strategy under the Obama administration that now also goes after an illegal immigrant’s employer and its managers.

The Memphis Buffet Is Being Investigated By The Department of Labor

The Fair Labor Standards Act catches another employer.  In 2007, the U.S. District Court for the Middle District of Tennessee awarded this judgment after determining that the restaurants’ owners, Min Fang Yang and Huo Guang Huang, violated the Fair Labor Standards Act by failing to pay the federal minimum wage, failing to pay overtime compensation for hours worked over 40 in a workweek and failing to maintain accurate records of hours worked by employees at the two restaurants.

The Department of Labor Settles Another Overtime Case

It happened again, another restaurant company is settling a overtime claim.  An investigation by the U.S. Department of Labor’s wage and hour division into the Great Wall Buffet found that 30 employees — cooks, kitchen workers, dish washers and waiters — were paid a fixed salary of $780 to $2,500 a month depending on their job. That averaged out to an hourly rate of $2.93 to $8.74.

New City Requirements May Have An Affect on Workers’ Status

Would your benefits be affected in the state of Georgia?  Under amended Georgia law 50-36-1 during the 2009 legislative session, city governments must verify whether a person is legally in the United States in the federal Systematic Alien Verification for Entitlements Program or SAVE before receiving benefits. Beginning Jan. 1, 2010, verification will be required for employee benefits, disability benefits and those seeking commercial/professional licenses.

Another Case of Overtime Violations Investigated

The three fake identities – Nazia Mahmood, Mariam Namagembe and Alison Taylor – were given similar experience and qualifications.

Grundy Slaughterhouse Was Targeted By A Federal Raid
