Working: Labor Steps Up Fight Against Wage Violations

Low-wage workers weren’t the only winners last week when the minimum wage increased to $7.25 an hour. Secretary of Labor Hilda L. Solis also announced the agency is hiring 250 more federal wage and hour investigators.

It’s welcome news to the thousands of workers cheated out of minimum wage and overtime pay each year.

Currently, the agency has about 650 investigators, but even with the increase, Solis said the agency is barely getting back to its 2001 staffing levels.

Effective Sept. 8, 2009, the Department of Homeland Security’s (DHS) E-Verify electronic employment verification system will be required for many government contractors and subcontractors. According to numbers released to the Center for Immigration Studies by the Department of Homeland Security, E-Verify is now being used to determine work authorization for one in four new hires in the United States.

What Do You Discriminated Against?

The federal government finally moved forward on E-Verify and will require all federal contract employers use the verification process to prove U.S. residency and ensure tax dollars are going to legal residents.

Immigration Detention: Enforcing a Double Standard

According to a massive report just released by the ACLU of Southern California, the National Immigration Law Center and other legal advocates, Immigration and Customs Enforcement’s detention centers have routinely blocked detainees’ contact with family members and advocates, cut off from critical health care services, and provided little legal recourse against maltreatment—all with virtually no meaningful oversight.

Everyone’s An Employer Under FLSA

So, the FLSA’s wage and hour provisions receive little attention in California. But with the bad economy and companies going bankrupt, the Ninth Circuit Court of Appeals may have just given plaintiffs a reason to heart federal court.

Boucher and a couple of others worked for the Castaways Hotel in Nevada. The Castaways filed for Bankruptcy protection. Later, it fired the plaintiffs. Undeterred by their former employer’s insolvency, they sued the CEO, CFO and a senior manager responsible for labor relations (hi, HR managers!).

How to Avoid Workplace Discrimination?
